The executor named in the will must apply to the High Court for a Grant of Probate. You will need the original will, a death certificate, an affidavit from the executor, and an inventory of the deceased assets and liabilities. If someone dies without a will (intestate), their estate is distributed according to the Distribution of Estates Act. The surviving spouse and children generally have priority.
